APPEALS
After entry of a guilty judgment, a defendant has the right to appeal the judgment. If the defendant made an appearance in open court, defendant has 10 days from date of judgment to file an appeal bond (The day after judgment is day one). A defendant who makes an appearance in writing must offer a plea of guilty of no contest and notify the court that he/she intends to appeal and must waive a jury trial. The judge then accepts plea and waiver of jury trial and signs judgment and sets amount of appeal bond. The Clerk of the Court mails by certified mail a notice to the defendant of the amount of the fine, costs, and appeal bond. The defendant has up to 31 days from receiving the notice from the court to file appeal bond with the court. The amount of the appeal bond cannot be less than two times the amount of the fine and court costs. Bond can be cash or surety. |
